Estes Termos de Serviço ("Termos") regem o seu acesso e uso da Nova Uptime, um serviço de monitoramento de uptime de sites e saúde de e-mail operado pela Antifragile Technologies L.L.C-FZ ("nós", "nosso" ou "nos"), uma empresa registrada em Dubai, Emirados Árabes Unidos.

Section 1

Service Description

Nova Uptime provides website uptime monitoring, SSL certificate tracking, domain registration expiry monitoring, email health monitoring (DNS record validation and blacklist scanning), URL content change detection, periodic URL screenshots, response time analytics, failure screenshot capture, anonymous trial monitoring, team member collaboration, and multi-channel notification services including email, WhatsApp messaging, and outgoing webhooks. We monitor the websites you configure at your chosen intervals and send notifications based on your preferences through your selected communication channels. When you add or remove a domain, you will receive email confirmation of the action. Administrators may also send targeted communications to specific users for service-related purposes. Section 2

Account Registration

  • You must provide a valid email address to register. Email addresses are verified via a one-time password (OTP) sent to the address you provide.
  • You are responsible for maintaining the confidentiality and security of your account credentials. You agree to notify us immediately of any unauthorized use of your account.
  • One account per person. Automated account creation (bots, scripts) is not permitted.
  • You must be at least 16 years old to use the Service.
  • You agree that all information you provide during registration is accurate and that you will update it if it changes.
Section 3

Acceptable Use

You agree to use the Service responsibly and lawfully. Specifically, you agree not to:

  • Monitor websites you do not own or do not have explicit authorization to monitor.
  • Attempt to circumvent, disable, or manipulate rate limits, monitoring intervals, or domain limits.
  • Use the Service for any illegal, fraudulent, or unauthorized purpose.
  • Interfere with, disrupt, or overload the Service or its underlying infrastructure (servers, networks, databases).
  • Attempt to gain unauthorized access to other users' accounts, data, or the admin portal.
  • Resell, redistribute, sublicense, or white-label the Service without our prior written consent.
  • Use the Service to send spam, phishing emails, or other unsolicited communications.
  • Reverse-engineer, decompile, or attempt to extract the source code of the Service.
  • Use the Service to benchmark or test competing monitoring services.
  • Provide false or misleading information during registration or while using the Service.
  • Embed status widgets on domains other than the verified domain associated with the embed token.
  • Attempt to scrape, replicate, or redistribute data obtained through embed widgets or the monitoring API.
Section 4

Plans, Pricing & Billing

The Service offers three plan tiers: Free, Pro, and Agency. Each plan provides different domain limits, check intervals, and feature access. Full plan details and current pricing are available on our Pricing page.

One-Time Payments

Pro and Agency plans are purchased via one-time annual payments processed through Stripe. These are NOT subscriptions — there are no recurring charges and no automatic renewals. Records of all payment attempts (including pending, expired, and cancelled checkout sessions) are maintained for billing transparency.

Manual Renewal

When your plan period expires, you must manually purchase a new license to continue on a paid plan. We will send reminder emails at 30, 14, 7, 2, and 1 day(s) before expiry.

Grace Period

After your paid plan expires, you have a 7-day grace period during which all paid features remain active. If you do not renew within this period, your account will be downgraded to the Free plan.

Downgrade Behavior

When downgraded to Free, your most recently active domains (up to the Free plan limit) will remain active. All other domains will be paused. Check intervals will be reset to the Free plan minimum. You will not lose any data — paused domains can be resumed after upgrading.

Domain Add-Ons

Pro and Agency users may purchase domain add-on packs. Add-on pricing is prorated to your license anniversary date, so you only pay for the remaining time on your current plan period.

Plan Upgrades

Pro users may upgrade to Agency at any time. A prorated credit is applied based on the unused portion of the Pro license. The credit is automatically deducted from the Agency plan price at checkout.

Refunds

Refund requests are handled on a case-by-case basis. If a refund is issued, the associated license is immediately revoked and your account is downgraded to the Free plan.

We reserve the right to modify plan limits, features, and pricing with reasonable notice (at least 30 days via email). Changes will not affect the terms of an active, unexpired license — they apply only at the time of next purchase or renewal.

Section 5

Intellectual Property

The Service, including its software, design, branding, documentation, and all associated intellectual property rights, is owned by Antifragile Technologies. These Terms do not grant you any ownership rights to the Service.

Our IP

The Nova Uptime name, logo, user interface design, API, and all related code, documentation, and creative works are our exclusive property or licensed to us.

Your Data

You retain all rights to the data you provide (domain URLs, notification preferences, CC emails). We do not claim ownership of your data.

License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service in accordance with these Terms.

Feedback

If you provide feedback, suggestions, or ideas about the Service, you grant us a perpetual, irrevocable, royalty-free license to use and incorporate such feedback.

Section 6

Service Availability & Monitoring Accuracy

We strive to maintain high availability of the monitoring service, but we do not guarantee 100% uptime of the Service itself. You acknowledge and agree that:

  • The Service may experience downtime for maintenance, updates, or unforeseen technical issues.
  • Monitoring results are provided on a best-effort basis. We cannot guarantee detection of every outage, SSL issue, domain expiry event, or email deliverability issue.
  • Network conditions, DNS propagation, CDN caching, and third-party service behavior may affect monitoring accuracy.
  • Response time measurements are approximate and may vary due to network conditions between our servers and your monitored websites.
  • Domain expiry detection relies on public RDAP and WHOIS data, which may be incomplete, delayed, or inaccurate for certain TLDs or registrars.
  • Email health scores are based on DNS record checks and blacklist lookups at a point in time. Deliverability may be affected by factors beyond DNS configuration that we do not monitor.
  • Email notifications depend on third-party email delivery services and may be delayed or filtered by recipient email providers.
  • WhatsApp notifications are delivered through the WhatsApp platform. Delivery depends on recipient phone settings, internet connectivity, and regional availability. Message delivery is not guaranteed and may be subject to delays.
  • Webhook notifications are delivered to URLs you configure on a best-effort basis. We are not responsible for failures caused by your webhook endpoint being unavailable, misconfigured, or returning errors.
Section 7

Embeddable Status Widgets

The Service offers embeddable status widgets that display real-time monitoring data on your websites. By enabling and using embed widgets, you agree to the following:

Domain Verification

Embed widgets are verified against the domain they are configured for. Widgets will only function when loaded from the verified domain or its subdomains.

Data Accuracy

Embed widgets display monitoring data on a best-effort basis. We do not guarantee the real-time accuracy, completeness, or availability of data shown.

Branding

All embed widgets include Nova Uptime branding ("Powered by Nova Uptime" with a link to novauptime.com). You agree not to remove, obscure, or modify this branding.

No Warranty

Embedded widgets are provided "as is." We are not responsible for any decisions made based on the monitoring data displayed in embed widgets.

Availability

We may modify, suspend, or discontinue embed widget functionality at any time.

Security

You are responsible for ensuring that the embed code is implemented correctly on your website.

Section 8

URL & Content Monitoring

Nova Uptime provides URL monitoring that tracks content changes on web pages you specify. By using this feature, you agree to the following:

Authorized Monitoring Only

You may only monitor URLs that you own, operate, or have explicit authorization to monitor. Do not use this feature to scrape or systematically collect content from third-party websites without permission.

Content Hashing

We use SHA-256 hashing to detect content changes. We store content hashes, line-level diff summaries, and added/removed line counts — not the full page content.

Screenshots

Periodic screenshots are captured using a headless browser at your configured intervals. Screenshots are stored temporarily (30 days) and are accessible only to you and authorized team members.

Accuracy Disclaimer

Content change detection is provided on a best-effort basis. Dynamic content, JavaScript-rendered pages, CAPTCHAs, login walls, and anti-bot protections may affect detection accuracy. We do not guarantee detection of every change.

Rate Limits & Fair Use

URL check intervals are governed by your plan tier (Free: 24h, Pro: 3h minimum, Agency: 1h minimum). Excessive monitoring of third-party URLs may be restricted at our discretion.

Plan Limits

The number of monitored URLs is limited by your plan: Free (5 URLs), Pro (100 URLs), Agency (1,000 URLs). Additional URLs beyond your plan limit require a plan upgrade.

Section 9

Anonymous Trial

Nova Uptime offers a free anonymous trial that allows you to monitor up to 5 domains for 30 minutes without creating an account. By using the trial, you agree to the following:

Trial Duration

The trial is displayed as 30 minutes but may run for up to 40 minutes on the backend. After expiry, all trial data (domains, check history) is automatically deleted.

No Guarantee

Trial monitoring is provided on a best-effort basis at free-tier check intervals (every 15 minutes). No guarantee of service continuity or data accuracy is provided during the trial.

Session Security

Your trial session is locked to the browser that created it using your user agent. You cannot share the trial session URL with others — unauthorized access attempts will be redirected to the sign-up page.

Rate Limiting

You may create up to 3 trial sessions per IP address per hour. Excessive trial creation may result in temporary blocks.

Data Collection

During the trial, we collect your IP address and user agent for security purposes. See our Privacy Policy for full details on trial data handling.

Account Claiming

You may claim your trial by creating an account before the trial expires. Your monitored domains will be transferred to your account, subject to your plan limits.

Section 10

Account Claiming & Domain Transfer

When you claim a trial session by providing your email and verifying via OTP:

  • If you are a new user, an account is automatically created for you on the Free plan.
  • If you already have an account, your trial domains are added to your existing account.
  • Domains are transferred subject to your plan limits. Domains that fit within your remaining slots are activated immediately. Excess domains are added but suspended — you can upgrade your plan to activate them.
  • Domains already being monitored in your account (duplicate URLs) are automatically skipped during transfer.
  • Once claimed, the trial session is marked as complete and cannot be reused.
Section 11

User Profile Information

You may provide optional profile information including your name, business name, phone number, address, and tax identification number. By providing this information:

  • You represent that the information is accurate and up-to-date.
  • Profile data may be used for billing purposes, including displaying your name and address on payment receipts.
  • When you make a Stripe payment, your billing details may be automatically synced to your profile (only filling empty fields, never overwriting existing data).
  • Tax identification numbers are used solely for invoicing purposes and are not shared with third parties except as required for tax compliance.
Section 12

Email Address Changes

You may change the email address associated with your account through a dual-verification process:

  • A verification code is first sent to your current email address to confirm your identity.
  • After verifying your identity, a second code is sent to your new email address.
  • Once both codes are verified, your email is updated immediately and a new authentication token is issued.
  • A confirmation notification is sent to your old email address for security purposes.
  • You cannot change your email to an address already registered with another account.
  • You are responsible for ensuring that your email address is always current and accessible, as it is the primary channel for account recovery and notifications.
Section 13

WhatsApp Notifications & Webhooks

Nova Uptime supports WhatsApp messaging and outgoing webhooks as notification channels. By enabling these channels, you agree to the following:

WhatsApp Connection

To receive WhatsApp alerts, you connect your WhatsApp account to Nova Uptime via a one-time pairing process. This confirms you own the WhatsApp account and consent to receiving monitoring notifications. You may disconnect your WhatsApp account at any time from your account settings.

WhatsApp Notifications

WhatsApp alerts are delivered to your connected WhatsApp account for monitoring events such as website downtime, recovery, SSL certificate issues, domain expiry warnings, and email health changes. You must have an active WhatsApp account to receive these notifications. WhatsApp messaging is subject to Meta's (WhatsApp) Terms of Service.

Outgoing Webhooks

You may configure webhook endpoints (HTTPS URLs) to receive real-time JSON payloads for monitoring events. All webhook payloads are signed using HMAC-SHA256 with a secret key provided to you at configuration time. We deliver webhooks on a best-effort basis with automatic retries. Webhooks that fail consecutively may be automatically disabled.

Per-Domain Configuration

Notification channels (WhatsApp, webhooks) are configured on a per-domain basis. You choose which connected WhatsApp accounts and webhook endpoints receive alerts for each monitored domain. You may enable or disable individual channels at any time.

Opt-Out

You may disable WhatsApp or webhook notifications at any time through your domain settings. Disconnecting your WhatsApp account immediately stops all future WhatsApp notifications. You remain responsible for messages received prior to disconnection.

WhatsApp Terms

WhatsApp messaging is subject to WhatsApp's Terms of Service and Privacy Policy. By connecting your WhatsApp account, you acknowledge that WhatsApp message delivery is subject to Meta's platform availability and policies.

Section 14

Webhook Data Delivery

When you configure outgoing webhooks, monitoring event data is delivered to your specified HTTPS endpoints. By using this feature, you acknowledge:

  • Webhook payloads contain monitoring data including domain URLs, event types (downtime, recovery, SSL issues, etc.), timestamps, and status information. No personally identifiable information beyond what you configure is included.
  • You are solely responsible for the security and availability of your webhook endpoints. We require HTTPS-only URLs and block delivery to private/internal IP addresses for security.
  • Each webhook payload is signed with HMAC-SHA256 using a unique secret key. You are responsible for verifying the signature on your end to ensure payload authenticity.
  • We retain webhook delivery logs (event type, delivery status, response codes) for troubleshooting purposes. These logs are retained for 90 days.
  • Webhooks that experience 10 or more consecutive delivery failures are automatically disabled to prevent unnecessary load on your systems. You can re-enable disabled webhooks from your dashboard.
Section 15

Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, store, and protect your data. By using the Service, you consent to the data practices described in the Privacy Policy.

Section 16

Limitation of Liability

To the Maximum Extent Permitted by Applicable Law:

  • The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
  • Nova Uptime and Antifragile Technologies shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, goodwill, or revenue.
  • Our total aggregate liability for any claims arising from or related to the Service shall not exceed the amount you have paid us in the twelve (12) months preceding the claim, or $100 USD, whichever is greater.
  • We are not liable for damages resulting from: missed notifications, inaccurate monitoring data, delayed alerts, failure to detect outages or SSL/domain issues, or any actions you take based on information provided by the Service.
  • We are not liable for any losses arising from the use of embeddable status widgets, including inaccurate data displayed to your website visitors or widget downtime.
  • We are not liable for any consequences arising from email health scores, domain expiry predictions, blacklist results, or any other informational data provided by the Service.
  • We are not liable for failed, delayed, or undelivered WhatsApp messages caused by Meta/WhatsApp platform availability, account settings, or regional restrictions.
  • We are not liable for any losses arising from failed webhook deliveries, including missed notifications due to your webhook endpoint being unavailable or misconfigured.
  • You acknowledge that the Service is a supplementary monitoring tool and should not be your sole method of monitoring website availability, security, or email deliverability.
Section 17

Indemnification

You agree to indemnify, defend, and hold harmless Antifragile Technologies, its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from:

  • Your use of the Service or any activity under your account.
  • Your violation of these Terms or any applicable law or regulation.
  • Your violation of any third party's rights, including intellectual property or privacy rights.
  • Monitoring websites without proper authorization from their owners.
Section 18

Termination

Either party may terminate this agreement as follows:

By You

You may delete your account at any time by contacting us at Contact us. Upon request, we will provide a data export before deletion.

By Us

We may suspend or terminate your account immediately if you violate these Terms, engage in abusive behavior, or pose a risk to the Service. We may also terminate accounts inactive for more than 12 months.

Effect of Termination

Upon termination, your right to use the Service ceases immediately. Your monitoring data will be deleted within 30 days. Provisions that should survive termination (Limitation of Liability, Indemnification, Dispute Resolution) will survive.

Section 19

Dispute Resolution

In the event of any dispute, claim, or controversy arising from or related to these Terms or the Service:

Informal Resolution

You agree to first attempt to resolve any dispute informally by contacting us at Contact us. We will make reasonable efforts to resolve the dispute within 30 days.

Binding Arbitration

If informal resolution fails, you agree that any remaining dispute shall be resolved through binding arbitration administered under the rules of the applicable arbitration body, rather than in court.

No Class Actions

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

Small Claims Exception

Either party may bring qualifying claims in small claims court.

Section 20

Force Majeure

Neither party shall be liable for any failure or delay in performance resulting from causes beyond their reasonable control, including but not limited to: natural disasters, acts of war or terrorism, pandemics, government actions, power outages, internet or telecommunications failures, cyberattacks (DDoS, ransomware), third-party service outages (DNS providers, CDN networks, email delivery services, WhatsApp/Meta platform availability), and hardware failures. We will make reasonable efforts to mitigate the impact and resume normal service as quickly as possible.

Section 21

Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the United Arab Emirates, without regard to its conflict of law provisions. Any legal proceedings arising from these Terms shall be brought in the courts located in Dubai, UAE, and you consent to the personal jurisdiction of such courts.

Section 22

Changes to Terms

We may update these Terms from time to time. When we make material changes:

  • We will update the "Last updated" date at the top of this page.
  • We will notify registered users via email at least 15 days before significant changes take effect.
  • Continued use of the Service after changes are posted constitutes acceptance of the new Terms.
  • If you do not agree with the updated Terms, you must stop using the Service and may request account deletion.
Section 23

Severability

If any provision of these Terms is found to be unenforceable, invalid, or illegal by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The unenforceable provision shall be modified to the minimum extent necessary to make it enforceable while preserving its original intent.

Section 24

Entire Agreement

These Terms, together with the Privacy Policy and any additional terms displayed when enabling specific features (such as embeddable widgets and multi-channel notification services), constitute the entire agreement between you and Antifragile Technologies regarding the use of the Service. These Terms supersede all prior agreements, understandings, and communications (written or oral) between the parties regarding the subject matter herein.
